Common-law reasonable notice usually exceeds the statutory minimum and is highly specific to your situation. This is a rough estimate for guidance only, not a prediction. Many employees are owed more.
This calculator estimates the ESA statutory minimum and shows a rough common-law range for general guidance only. Common-law reasonable notice is highly fact-specific and is frequently higher than these estimates. This is not legal advice. Do not sign a severance offer without advice.
- How much severance am I entitled to in Ontario?
- The Employment Standards Act sets minimums: up to eight weeks of termination pay, plus up to 26 weeks of severance pay if you have five or more years of service and your employer’s payroll is at least $2.5 million. Common-law reasonable notice, based on your age, service, role, and the job market, is often much higher.
- Is the statutory minimum all I can get?
- Usually not. Most non-unionized employees are entitled to common-law reasonable notice, which frequently exceeds the statutory minimum. The first offer is typically a starting point.
- Should I sign my severance offer right away?
- No. There is no fixed legal deadline. You are entitled to reasonable time to review the offer and get independent legal advice before signing a full and final release.
Offered a severance package?
The minimum is rarely the most you are owed. Have your offer reviewed before you sign — book a consultation.
